ARTICLE 1 – OBJET
Les présentes CGV régissent les prestations proposées par Julien Mangogna :
Croisières sur mesure
Skipper professionnel
Convoyage de navires
Accompagnement à l'achat de voilier
Mentoring et coaching nautique
Conseil et assistance à la navigation
ARTICLE 2 – DEVIS ET RÉSERVATION
Toute prestation fait l'objet d'un devis ou d'une proposition commerciale.
La réservation devient définitive après acceptation du devis et versement de l'acompte demandé.
ARTICLE 3 – TARIFS
Les prix sont exprimés en euros.
Les frais de port, de déplacement, de carburant, de marina, d'avitaillement ou autres frais spécifiques peuvent faire l'objet d'une facturation complémentaire lorsqu'ils ne sont pas inclus dans le devis.
ARTICLE 4 – MODALITÉS DE PAIEMENT
Un acompte pouvant aller jusqu'à 50 % du montant total peut être demandé à la réservation.
Le solde est exigible avant le départ ou selon les modalités prévues au devis.
ARTICLE 5 – ANNULATION PAR LE CLIENT
Plus de 60 jours avant la prestation :
remboursement des sommes versées, déduction faite des frais engagés.
Entre 60 et 30 jours :
50 % des sommes versées restent acquises.
Moins de 30 jours :
100 % des sommes versées restent acquises sauf accord particulier.
ARTICLE 6 – CONDITIONS MÉTÉOROLOGIQUES
Le skipper demeure seul décisionnaire concernant le maintien, la modification ou l'annulation d'une navigation.
Toute décision prise pour des raisons de sécurité maritime ne pourra engager sa responsabilité.
Selon les circonstances, une prestation pourra être reportée ou partiellement remboursée.
ARTICLE 7 – FORCE MAJEURE
Aucune partie ne pourra être tenue responsable en cas d'événement imprévisible, irrésistible et extérieur empêchant l'exécution de la prestation.
ARTICLE 8 – APTITUDE DES PARTICIPANTS
Chaque participant déclare être physiquement apte à embarquer et à participer à une activité nautique.
Toute condition médicale particulière doit être signalée avant le départ.
ARTICLE 9 – ASSURANCES
Le client est invité à souscrire toute assurance voyage, assistance, rapatriement ou annulation qu'il juge utile.
ARTICLE 10 – RESPONSABILITÉ
L'entreprise est tenue à une obligation de moyens.
Sa responsabilité ne pourra être engagée en cas de dommages résultant :
d'un comportement fautif du client ;
d'informations inexactes fournies par celui-ci ;
d'un cas de force majeure ;
d'une décision prise dans l'intérêt de la sécurité maritime.
ARTICLE 11 – CONVOYAGE DE NAVIRE
Le propriétaire garantit que le navire est apte à la navigation et dispose des équipements de sécurité réglementaires.
Les éventuelles avaries préexistantes doivent être signalées avant le départ.
ARTICLE 12 – ACCOMPAGNEMENT À L'ACHAT
Les prestations de conseil n'ont pas pour objet de se substituer aux expertises techniques, expertises maritimes ou diagnostics spécialisés réalisés par des professionnels habilités.
ARTICLE 13 – MENTORING ET FORMATION INFORMELLE
Les prestations de mentoring nautique visent à transmettre une expérience pratique de la navigation.
Elles ne constituent pas une formation diplômante ou certifiante.
ARTICLE 14 – CONFIDENTIALITÉ
Les informations échangées entre les parties sont considérées comme confidentielles.
ARTICLE 15 – MÉDIATION DE LA CONSOMMATION
Conformément aux articles L.612-1 et suivants du Code de la consommation, le client consommateur peut recourir gratuitement à un médiateur de la consommation.
ARTICLE 16 – DROIT APPLICABLE ET LITIGES
Les présentes CGV sont soumises au droit français.
Tout litige sera recherché en priorité par voie amiable avant toute procédure judiciaire.

ARTICLE 1 – PURPOSE
These Terms and Conditions govern the services provided by Julien Mangogna, including:
* Bespoke yacht charters and custom sailing cruises
* Professional skipper services
* Vessel delivery and yacht relocation services
* Assistance with yacht acquisition and purchase projects
* Nautical mentoring and coaching
* Navigation consultancy and advisory services
ARTICLE 2 – QUOTATIONS AND BOOKINGS
All services are subject to a quotation or commercial proposal.
A booking shall be deemed confirmed upon acceptance of the quotation and receipt of the required deposit.
ARTICLE 3 – FEES AND CHARGES
All prices are stated in Euros (€).
Port fees, travel expenses, fuel, marina charges, provisioning costs, and any other specific expenses may be invoiced separately where not expressly included in the quotation.
ARTICLE 4 – PAYMENT TERMS
A deposit of up to 50% of the total amount may be required at the time of booking.
The remaining balance shall be payable prior to departure or in accordance with the payment schedule specified in the quotation.
ARTICLE 5 – CANCELLATION BY THE CLIENT
More than 60 days prior to the commencement of the service:
Amounts paid shall be refunded, less any costs already incurred.
Between 60 and 30 days prior to the commencement of the service:
50% of the amounts paid shall be retained.
Less than 30 days prior to the commencement of the service:
100% of the amounts paid shall be retained, unless otherwise agreed in writing.
ARTICLE 6 – WEATHER CONDITIONS
The skipper shall retain sole discretion regarding the continuation, modification, postponement, or cancellation of any voyage or navigation activity.
Any decision taken in the interest of maritime safety shall not give rise to liability on the part of the skipper or the Company.
Depending on the circumstances, a service may be postponed or partially refunded.
ARTICLE 7 – FORCE MAJEURE
Neither party shall be held liable for any failure or delay in performing its obligations resulting from an event beyond its reasonable control, including any event constituting force majeure under applicable law.
ARTICLE 8 – PARTICIPANT FITNESS
Each participant warrants that they are physically fit to embark upon and participate in nautical activities.
Any relevant medical condition or circumstance likely to affect participation must be disclosed prior to departure.
ARTICLE 9 – INSURANCE
Clients are strongly encouraged to obtain any travel, medical assistance, repatriation, cancellation, or other insurance coverage they deem appropriate.
ARTICLE 10 – LIABILITY
The Company is subject to an obligation of reasonable skill and care and does not guarantee any specific outcome.
The Company shall not be liable for any loss, damage, injury, or expense arising from:
* the client's own negligence, misconduct, or failure to follow instructions;
* inaccurate, incomplete, or misleading information provided by the client;
* a force majeure event;
* any decision taken in the interest of maritime safety.
ARTICLE 11 – VESSEL DELIVERY SERVICES
The vessel owner warrants that the vessel is seaworthy and equipped with all safety equipment required by applicable regulations.
Any known defects, damage, or deficiencies affecting the vessel shall be disclosed prior to departure.
ARTICLE 12 – YACHT ACQUISITION ASSISTANCE
Advisory services relating to yacht acquisition are provided solely for guidance purposes and shall not replace technical surveys, marine inspections, valuations, or specialist assessments carried out by qualified professionals.
ARTICLE 13 – MENTORING AND INFORMAL TRAINING
Nautical mentoring services are intended to share practical sailing knowledge and experience.
Such services do not constitute accredited, certified, or professional training and do not lead to any qualification, certificate, or licence.
ARTICLE 14 – CONFIDENTIALITY
All information exchanged between the parties in connection with the services shall be treated as confidential and shall not be disclosed to third parties without prior consent, except where required by law.
ARTICLE 15 – CONSUMER MEDIATION
In accordance with Articles L.612-1 et seq. of the French Consumer Code, any consumer client may have recourse, free of charge, to an approved consumer mediation service.
ARTICLE 16 – GOVERNING LAW AND DISPUTE RESOLUTION
These Terms and Conditions shall be governed by and construed in accordance with the laws of France.
The parties shall seek to resolve any dispute amicably before initiating any legal proceedings. Any dispute not resolved amicably shall be submitted to the competent French courts.
